(1) exclusive right
Exclusive right refers to the right of the trademark owner to own exclusive use of the designated goods or services in accordance with the law of the registered trademark. The exclusive right to use a registered trademark shall be limited to the registered trademark and the commodities approved and used.
(two) the right of licensing
License means the right of a trademark holder to authorize another to use his registered trademark by signing a trademark license contract. The Licensee shall supervise the quality of the commodities in which the licensee uses his registered trademark, and the licensee must indicate the name of the licensee and the place of origin of the goods on the commodity that uses the registered trademark. The trademark license contract shall be submitted to the Trademark Office for the record. The contract for the use of the trademark license has not been filed and does not affect the validity of the license contract, except as otherwise agreed upon by the parties. If the trademark license contract is not filed with the Trademark Office, it may not engage in the fight against bona fide third parties. The types of licensing include exclusive use license, exclusive use permission and common use license.
(three) the right of transfer
The right of trademark transfer refers to the right of a trademark holder to lawfully assign its registered trademark according to law, procedures and conditions, and transfer it to another person. Where the registered trademark is transferred, the assignor and the assignee shall sign a transfer agreement and jointly submit an application to the trademark office. The owner of a registered trademark on the same or similar goods identical or similar trademarks registered, shall not be transferred; together with the transfer of the Trademark Office, notify the correction within a prescribed time limit; expiry not correct, as a waiver of the transfer of the application for trademark registration, the Trademark Office shall notify the applicant in writing. If the registered trademark is approved, it shall be announced, and the assignee shall enjoy the right of exclusive use of the trademark as of the date of the announcement. The assignee shall guarantee the quality of the goods to which the registered trademark is used. The transfer of a registered trademark shall not affect the validity of the trademark licensing contract which has become effective before the transfer, except as otherwise stipulated in the trademark licensing contract.
(four) right of renewal
Renewal refers to the right of trademark rights in the registered trademark before its expiry date, shall enjoy the application for renewal of registration, so as to extend its registered trademark rights protection. The period of validity of a registered trademark shall be 10 years, counting from the date of approval of the registration. The registered trademark expires, the need to continue to use, the registration shall be made within 6 months before the expiration for renewal; during this period failed to apply, can be given a grace period of 6 months. Each renewal of registration shall be 10 years, since the trademark expires on the next day to calculate. Spread the expiration not yet apply, the cancellation of its registered trademark.
(five) the right of designation
Where a trademark registrant uses a registered trademark, he or she has the right to indicate the word "registered trademark" or the sign of registration. Where goods are not marked on the goods, they may be marked on the packages or instructions and other attachments.
(six) right of prohibition
The right of trademark prohibition is the right of a trademark holder to prohibit others from using their registered trademarks and similar trademarks without their own permission. According to article fifty-second of the trademark law, a registered trademark holder has the right to prohibit others from using the same or similar trademarks as their registered trademarks on the same commodity or similar commodity without permission.
